Tuesday 26 June 2018/ Hour 4, Block B:  Adam J. White, research Fellow at the Hoover Institution, and director of the Center for the Study of the Administrative State at George Mason University's Antonin Scalia Law School, in re: The administrative state. I describe ht character of the government, one that’s first and foremost administrative. The White House is he prime mover while Congress sits back and acts as ombudsman. Administrative Law Judges (ALJ) don't sit o and consider the Constitution; they work within agencies, a sort of JV court.  Agency employees designated as judges.  The Supreme Court is interested to se if these ALJs are “officers” or not; decided not.   The Chevron Deference (1984):  When a Fed statute is ambiguous (and most are), court shd defer to the agency’s reasonable interpretation.  . . .  Calls to set aside the Chevron Deference.  See:  http://blog.acton.org/archives/102091-why-the-administrative-state-needs-to-shrink.html  and Wall Street Journal op-ed.
